Is there some licensing required to sell scion wood? I didn't think Art was looking for royalties or anything on his trees. I'm probably missing something?

I certainly can't speak for Art, but I'm pretty sure he's not looking for any kind of compensation for his varieties. I was just surprised at how quickly some of his varieties (and one of mine) spread to other sources.

I was encouraged to patent or some such thing, but have never done so. I don’t want the headaches of dealing with it.

I was encouraged to patent or some such thing, but have never done so. I don’t want the headaches of dealing with it. Ryan advised me to trademark Smitty's Seedling. I told him I didn't really care if somebody else wants to make money off selling the tree. Even if you TM a variety, somebody else could simply re-name it and then sell it under that name (just like Bill's Redflesh crab and Firecracker crab). My interest in Smitty's was getting other folks to grow it and to have the variety live on in other places.
