Gents,
I found where the deer were hanging out on the north side of the property. Typically they are absent this time of year and have moved off to greener pastures. Out walking the perimeter last week I saw the north neighbor had corn out, likely for the pheasants and turkeys. We are in a CWD no feeding zone as a side note. I went out yesterday and moved a camera right on the border where trails led to the neighbors corn. At least 5 different deer used that trail last night and this morning. 2 days left of season, I'd love some venison in the freezer but...
Legally I can shoot these deer per the regs: "A person otherwise in compliance with this section who is hunting on private or public property that is adjacent to the property where bait or food is present is NOT in violation if the person has not participated in, been involved with, or agreed to baiting or feeding wildlife on the adjacent property."
Ethically it sure doesn't sit well with me as I'm against baiting.
What says you?

Particularly if later, you would feel guilty about it. Others may do things differently but it sounds like you have answered your own question.

It it's against your personal ethics and you'd feel like shit every time you took a package of that venison out of the freezer, don't do it.

You can't shoot deer where they aren't. You didn't put the bait there and move the deer to there.
You scouted for recent deer activity and found some. It's not like you put out a pile of bait and just waited for the deer to come to it.
Go get some venison.

What would have done if you didn't see the bait? I would have put up a camera and likely hunted the north end with a south wind...thinking I may just try a spot and stalk on the last day working my way through the pines looking for them bedded...and not just sit and wait for them to walk by on their way to the bait pile.

You didn't put out the illegal bait, so I don't see an issue with hunting where you saw deer sign on your property regardless of the reason they are there. Lot of people illegally bait and feed, but I don't think neighbors should be expected to quit hunting because someone else is violating the law.

I believe it wasnt long ago that if you knew bait was in the area it was illegal to hunt.

Good question though by the way, very interesting to see everyone's thoughts on the matter.
My neighbor has been caught baiting and feeding illegally many times, so I probably couldn't hunt if I needed to wait for him to follow all the laws.

I would base the decision on where are the deer moving? If the neighbors feeds corn, and/or has a corn plot… you can intercept the deer if they bed on your property?
His feeding should not ruin your hunt!
Just my thoughts.

If it was a giant , I’d probably pass because of the attention it would get and the corn advantage (ethics) … small buck or doe—I’d be out there. It’s no slam dunk late season doe hunting ! We’ve been out and they are spooky !
